This website is operated by Albany Equipment Limited. Throughout the site, the terms “we”, “us” and “our” refer to Albany Equipment Limited. Albany Equipment Limited offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

We reserve the right to refuse service to anyone at any time for any reason.

Business to Business

Albany Equipment Limited are suppliers and distributors of catering equipment and services to commercial customers therefore all sales are considered a business to business contract.

Stock availability

We endevour to let you know the availability of an item on the website but sometimes there may be an occasion when a product is not available and this is information is not shown on the site. Should this happen we will get in touch with you as soon as possible to try and resolve the issue and discuss an alternative solution. (This could be place on back order for delivery when back in stock, supply of an alternative, suitable product or simply a refund and cancellation of the order)

Suitability of the Goods

We do not, in any circumstances, supply goods on approval or trial basis. It is your responsibility to check that the goods that you order are suitable for your requirements and the purpose for which you intend to use them before you place your order. It is also your responsibility to ensure that all services of water, drainage, power ventilation/extraction etc are appropriate for the goods supplied and are to current specification and that the water softeners are fitted in hard water areas. ALL GAS POWERED PRODUCTS MUST BE INSTALLED BY A GAS SAFE FITTER and all electrical goods by a qualified fitter. Albany Equipment Limited will not accept any liability for damage to goods or any other liability or loss caused by incorrect fitting or installation.

We have taken all reasonable care that all descriptions, details and specifications are accurate. However, all sizes, colours, dimensions and measurements should be treated as being approximate. Payments

All transactions on the Albany Equipment Limited website go through a merchant gateway, which is a secure payment service. None of your payment details are stored on the website, so that your information is kept extra safe.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. We have made all reasonable efforts to make sure the information shown on our website is accurate and up to date but we do not accept any liability for manufacturers specification changes.

How can you use information on the site?

Warranties and Liability

If you come across any faults or issues with your product after you have purchased it, your must first check through the comprehensive user manuals that are supplier with your product to ensure that there actually is a problem. You are also advised to contact the manufacturer directly or us at Albany Equipment Limited if the troubleshooting guide within the manual gives no solution.

If your item requires a warranty call, please call our service dept on 01384 416943 for advice and instruction.

We reserve the right to take a debit or credit card or other type of payment in advance of arranging a warranty service call. The payment will be refunded if the fault is covered by the manufacturers warranty but will be retained if the product fault or defect is not covered. Examples of exclusions include, but are not limited to; incorrect installation, damage, misuse or lack of maintenance including descaling and cleaning. Further information about exclusions is in the manual supplied with your product.

Albany Equipment Limited will not be liable for any lost profits or business interruption that may have directly, indirectly or incidentally arisen from a faulty or defected unit. It is the customer’s responsibility to plan and prepare for such instances.

Parts only warranty

A parts only warranty allows you to use your own sourced fully qualified engineer (at your own cost) to assess the problem. This must be followed by a full engineers report sent back to ourselves, which we will then forward onto the product manufacturer. Once approved by the manufacturer the parts required will be sent to your desired location. The manufacturer requests that the defective parts are to be sent back on repair of the unit. Failure to send these defective parts back is unacceptable and will result in a full invoice for the replacement parts.

Any equipment installed into a mobile catering unit, a none UK mainland address or an offshore site will invalidate the standard manufacturers warranty stated on our product pages within this website. In some instances the manufacturers warranty may be limited to a parts only warranty. Please call 01384 416943for further information.

Back to base warranty

Customers must arrange for any faulty product(s) to be returned to the manufacturer for repair when the items are covered by a back-to-base warranty. Please ensure that the product(s) are well packaged as neither Albany Equipment Limited nor the manufacturer will accept any responsibility for any loss or damage caused due to poor packaging when the item is in transit.

Please call 01384 416943 to obtain a returns number for your package from the manufacturer. You may need to complete a warranty service request form, which requires your signature and an original invoice number. This will be emailed to you upon request

Comments and Feedback

We love to hear your feedback and comments and we are very open to any suggestions you may have. Any comments or feedback that are submitted to Albany Equipment Limited will be dealt with as soon as possible. Please note that once the feedback or comment has been submitted, it becomes the property of Albany Equipment Limited and may not be treated as confidential.

3rd party websites

We may, throughout the site provide a link to a 3rd party website to give you the further information about a product. However, Albany Equipment Limited is not responsible for nor endorse the content that is published on these websites.

Delivery

We do all that we can to get your order delivered on time and by the estimated delivery date on the website. However, Albany equipment Limited is not liable for any delays to these deliveries.

Standard delivery is to kerbside. The delivery driver may at their discretion assist with delivering the goods to a location within the premises nominated by the customer, at the customer’s sole risk.

Standard deliveries take place between the hours of 8am-6pm Monday to Friday.

Large items may be delivered on an 18 ton vehicle. It is the customer’s responsibility to check that there is adequate access for such a vehicle. Failure to do so may result in extra costs being incurred due to a failed/aborted delivery. Re delivery cost may apply also.

When a product is delivered to you, the first thing you must do is inspect the goods for any damage. Failure to check the goods and document any damage with the driver will result in a claim for damage being rejected. Signing unexamined is not acceptable. In the event that the driver will not wait for you to inspect the goods, please sign for as ‘Damaged’. Once signed as damaged, you must report the damage to Albany Equipment Limited in writing within 24 hours to make a claim.

Delivery does not include the removal of old units or disposal of packaging materials (pallet, wrapping etc…). Collection and disposal of old units can be selected on a number of our products, in such cases where this service has been requested you must ensure that the items have been unplugged, disconnected, emptied and made ready for collection outside of the premises.

We will charge a redelivery fee if no one is available on site to take delivery of the goods.

A 25% restocking fee of the items value will be charged if delivery fails due to any of the points above, or if the product is returned and is not faulty. Please note that once an order has been placed and despatched the restocking fee will still apply.

Please DO NOT book any fitters or installers of the equipment ordered until after the goods have been delivered and inspected by yourself. We will not take any responsibility for any costs incurred as a result of arranging this in advance of delivery.

Customised / made to order goods

When special order or bespoke goods are ordered we will not accept ANY returns. You are responsible for ordering suitable goods for your requirements. If the goods are damaged, and you have signed for the goods as damaged when they were delivered then you may be able to make a claim against the manufacturer or supplier. No claims against the manufacturer or supplier for damage will be accepted if you have signed for goods without indicating any damage.

Returns

Goods sold in the UK mainland may be returned at the customers own cost for a refund providing that they are unused and in their original, sealed packaging. This excludes customised / made to ordered goods (See above). The restocking charge for returned items is 25% of the full invoiced amount. No goods are accepted for return after 14 days.

Please note, once an order has been placed and despatched the 25% restocking fee will still apply.

Refunds will only be paid once the returned goods have been inspected and after deduction of any restocking charges have been made. We will also deduct any costs for repairing any damage or replacing any missing components that were supplied with the original order.

Retention of Title

Notwithstanding that the goods have been delivered and accepted by you the ownership or legal title to the goods will not pass to you until you have paid in full for the goods supplied and there are no other sums of money due from you to Albany Equipment Limited. Until this time you will store or mark or keep the goods supplied in such a way as to make them clearly identifiable as our property.

Until such time all sums due to Albany Catering Equipment have been paid in full you will at our request deliver up the goods and you acknowledge that Albany Equipment Limited or their representatives will be entitled to enter any premises owned or occupied or controlled by you where the goods are situated for the purpose of recovering and repossessing the goods.
